Can I Recover Damages for My Injuries if the Driver Who Hit Me Doesn’t Have Insurance?

If you are injured by an uninsured driver who is unable to cover the damages they caused, you may still be able to recover compensation for your injuries.  One of the most common options is to pursue a claim under the uninsured or underinsured motorist coverage of your auto insurance policy.  While this is not mandatory coverage in Iowa, it is commonly included in most auto insurance policies.

This coverage can provide anywhere from as low as $20,000 to $750,000 or more, depending on your policy. Additionally, it often applies in the case of a hit and run where the at-fault driver cannot be identified and in instances where an insured driver simply does not have enough coverage to pay all your damages.
