How Comparative Fault Can Affect Your Personal Injury Case in Iowa.

In Iowa, if you are involved in a car accident or other type of personal injury case and you contributed to causing the accident, you are not automatically barred from recovering your damages.  However, if you are found to be more at fault than the defendant, you will not be eligible for compensation.  If you are less at fault, you can still recover damages, but the amount will be reduced in proportion to your percentage of fault. 

For example, if you are involved in a car accident at an uncontrolled intersection, the jury will determine the percentage of fault for both you and the other driver. If the jury finds you 25% at fault and the other driver 75% at fault, your damages will be awarded, but reduced by 25%.  So, if your total damages were $1,000,000, you would receive $750,000.
